What are the main criminal offences that can result from theft allegations?

Our criminal defence lawyers can offer expert legal advice on a range of theft and financial crime offences, ranging from burglary to identity fraud and more serious offences. Our theft solicitors can represent you in proceedings brought by the police, the Serious Fraud Office and the National Crime Agency, which investigates matters relating to organised crime.

The main offences under the Theft Act 1968 include:

  • Theft is defined as the dishonest appropriation of property belonging to someone else with the intention of permanently depriving them of it, this offence covers tangible property and money. It sometimes also covers intangible property and 'things in action', which might include debts. A conviction on theft charges can result in a prison sentence of up to seven years, but our criminal defence team can represent your interests and work to mitigate your sentence.
  • Burglary is committed when someone enters a building or part of a building as a trespasser with intent to commit theft, grievous bodily harm, or criminal damage. It can also be committed by entering as a trespasser and actually stealing or inflicting/attempting to inflict grievous bodily harm. A related offence, aggravated burglary, involves carrying a firearm, imitation firearm, weapon or explosive while entering someone's property. This also comes with a long custodial sentence, including a maximum sentence of life imprisonment if you are found guilty.
  • Robbery is theft carried out with the use or threat of force, immediately before or at the time of the theft, and in order to steal. It involves direct confrontation with the victim and, as such, is treated as a serious crime. Aggravated theft and robbery offences involving the use of a weapon can also lead to stronger charges. Without expert legal representation from a robbery solicitor, the maximum sentence ranges from 10 years to life imprisonment.
  • Handling stolen goods means receiving, retaining or dealing with stolen goods knowing or believing them to be stolen. A theft lawyer can defend you in criminal proceedings by proving that you did not know that the items in question were stolen, but it is important to start this process at your earliest opportunity.
  • Blackmail means making unwarranted demands with a view to gain or causing loss.

When intent to cause damage is present in a burglary offence, charges may be brought under the Criminal Damage Act 1971 in addition to the initial charges. The Computer Misuse Act 1990 also criminalises unauthorised access to computer systems and is often linked with theft or fraud offences. Finally, you may be charged under the Proceeds of Crime Act 2002, which governs several offences relating to benefiting from criminal property (for example, money laundering) and the processes by which the proceeds of crime can be seized and recovered.

Tyler Hoffman's criminal defence services include defending those accused of all of the above offences, from their initial police interview to the courtroom. If you have been invited for a voluntary interview or an interview under caution, or have been told you are facing criminal charges, speak to our theft lawyers for strategic advice based on our extensive knowledge of the law and our strategic approach to defence.

What about fraud offences?

Fraud offences are now prosecuted under the Fraud Act 2006, which was introduced to modernise deception and dishonesty offences that previously fell under the Theft Act. Our fraud lawyers can support you with a range of offences, including everything from identity theft offences to serious fraud. Cases involving widespread alleged fraud may be handled by multiple authorities working in tandem, and can quickly become complicated, so it is vital to work with an experienced solicitor from the outset to build the strongest possible defence.

Offences under identity fraud and related legislation include:

  • Fraud by false representation
  • Fraud by failing to disclose information
  • Fraud by abuse of position
  • Obtaining services dishonestly
  • Possessing, making or supplying articles for use in fraud

If you are accused of having acted dishonestly, or of a fraud offence like false accounting, the penalties can be severe. You may also find your bank accounts frozen, which can lead to inconvenience throughout the period of the investigation. It is vital in these cases to contact specialist theft solicitors at your earliest opportunity for advice and legal support.
