Is harassment a criminal offence?

The main legislation governing harassment is the Protection from Harassment Act 1997. This act makes it a criminal offence for a person to pursue a course of conduct that amounts to harassment of another if they know or ought to know that it amounts to harassment. As such, offences prosecuted under this act are criminal offences and will be tried in a criminal court.

The act was introduced to address stalking and other persistent forms of harassment but applies more broadly to any repeated behaviour that causes distress or alarm, including everything from unwanted phone calls to verbal abuse. Some types of harassment may also fall under domestic violence laws, with the Domestic Abuse Act 2021 meaning that some harassment offences between family members are treated more seriously. There is also an offence called "controlling or coercive behaviour in an intimate or family relationship" under the Serious Crime Act 2015.

In rare cases, harassment may be addressed through civil law at a county court. Victims could apply for an injunction under the Protection from Harassment Act, or claim they were harassed in the context of a civil employment or housing dispute.

What types of harassment offences are there?

There are several offences under the Protection from Harassment Act 1997, covering most of the main types of harassment under the law.

  • Harassment: This covers a course of conduct (i.e. at least two incidents) which causes alarm or distress. It is a summary offence (tried in the Magistrates’ Court) and can result in up to 6 months’ imprisonment, a fine or both.
  • Stalking: Introduced in 2012, this offence specifically addresses stalking behaviours. It can include:
    • following someone;
    • contacting them repeatedly;
    • loitering; or
    • monitoring the person online.
  • The penalties are the same as for harassment: a prison sentence of up to 6 months and/or a fine.
  • Harassment (putting people in fear of violence): This more serious offence involves harassment that causes the victim to fear that violence will be used against them. It can be tried in the Magistrates' Court or the Crown Court. When tried in the Magistrates' Court, the maximum sentence is up to six months in prison and a fine. For a conviction in the Crown Court, you could receive a prison sentence of up to five years in custody and a fine.
  • Stalking involving fear of violence or serious alarm or distress (section 4A): This offence covers stalking that causes serious psychological harm or fear of violence. It can lead to the same sentencing as harassment with fear of violence.

As well as these penalties, non-molestation orders are often used in domestic abuse contexts. This is a type of court order that can prohibit a wide range of behaviours and is designed to address the risk of further harassment after a sentence has been served. It may prohibit:

  • Using or threatening violence.
  • Harassing, pestering or intimidating the applicant or their children.
  • Communicating by phone, text, email, social media, or in person.
  • Coming near the applicant’s home, workplace or children’s school

Breaching such an order is a criminal offence, punishable by up to five years' imprisonment. Restraining orders issued following criminal proceedings may also prohibit contact with family members.
